06.12.14 Kurt Barker to present at Columbia Gorge SRHM June Chapter Meeting

As a human resources (HR) professional or business owner/manager, you know this:  a charge or lawsuit from an employee is the last thing you need.  But avoiding claims doesn’t seem to be getting any easier—lawmakers and courts keep adding new ways to trip you up, and the goal posts often seem to move.  How can you keep up and help make sure you’re not walking into an employee-claim nightmare?

Our seminar will highlight the following:

  • What are some best practices for avoiding employee claims?
  • What can you do right now to help minimize your potential exposure if a claim is filed down the road?

We hope you join us for a lively and interactive “talk from the trenches” with Karnopp Petersen’s experienced employment law team!

05.21.14 Kurt Barker to present to HRACO Chapter Meeting - Managing Medical Leave

Juggling the OFLA/FLMA, Disibility Laws, Workers Compentation Leave & More.

Your employee may be sick, so why are you the one with the headahce?

Determining an employee’s eligibility and managing legally-protected medical leave can be tricky -- and it only gets more complicated when workers’ compensation leave, and/or potential disability-related issues overlap.  And the state and federal regulations governing medical leave and disability issues seem to be ever-expanding.  In this hour-and-a-half session, we’ll cover the basic of each law, best practices for handling each type of leave and how these laws can overlap.  We’ll also dive in to scenarios – complicated “what would you do” problems that may challenge even the most experienced HR professional.  Join us for a lively discussion of the following:

  • Who is protected under the Oregon Family Leave Act (OFLA), and the Family and Medical Leave Act (FMLA)?  What about the ADA (which has been referred to as the “inadvertent leave law”), the Oregon Disability Law (which applies to those with just 6 or more employees), and Workers’ Comp leave?  What are the latest legal changes in these areas?
  • What are the critical legal definitions to know and issues to spot, including "serious health conditions,"  "qualifying exigencies” and more?  What rights does an employer have to question the need for medical leave?
  • How do the medical leave, workers’ compensation and disability laws work together?  And how do the recent legal changes affect your business and best practices?

We’ll cover these issue and much more, helping you to spot the issues where employers are most likely to get tripped up –- and work to help avoid the lengthy lawsuits that can follow mismanaged medical leave.  Whether you’re new to the administration of medical leave or a seasoned pro, you won’t want to miss our seminar!  Unless you’re really sick, of course.  (We won’t require a doctor’s note.)

Click here for more information and to RSVP.  This seminar is exclusively for HRACO members.

05.03.13 Karnopp Petersen presents Business 20/20 Executive Breakfast: Driving Innovation

Whether starting a new business or breathing life into an old one, staying competitive, getting to the next level, demands innovation.  Innovation means being the first, rethinking convention and inventing a new way of doing business.  It requires leaders to strive for more, change and re-create to gain market share, build new lines of business, improve processes, or stoke passion in an otherwise mediocre world.  Now more than ever, innovation is touted by business consultants and industry leaders as the silver bullet, the cure, for a downed economy, slow quarter or decreasing product line. But, how does a business innovate?

It's not like you can just flip on a switch. In this seminar, attendees will learn from real-world experiences of entrepreneurs and "intrepreneurs" that have defined what innovation means to their organization and made it a reality.  Keynote speaker, Intel’s Wilfred Pinfold, will outline practical steps for fostering innovation in a new or established business. He will also provide a guide to defining and creating innovation, including:

  • Identifying common pitfalls
  • Examining how strategy changes based on the business’s size and stage
  • Developing an innovative culture that can grow ideas into profitable business revenue

Dr. Pinfold is the Director of Extreme Scale Programs at Intel and leads Intel’s Government Programs office specializing in technology innovation.  Pinfold also helped co-develop Portland State University’s innovation program and currently teaches in the university’s MBA program.

Dr. Pinfold will be joined by a dynamic panel of Central Oregon business leaders who will share their experiences as living case studies succeeding locally.

You’re invited to the Karnopp Petersen Business 20/20 Executive Breakfast and Seminar. Doors open at 7:15 a.m.  Ticket Price is $25 Per Person (Includes Breakfast).  Visit www.kpbusiness2020.com for more information and to register.

06.26.12 Karnopp Petersen's Kurt Barker and Jon Napier to present at the Bend Chamber of Commerce Business Success Program: Will The Real Independent Contractors Please Stand Up.

Many businesses are turning to or considering independent contractors as an effective way to address their business and staffing needs. The potential flexibility and tax advantages can look like a win-win scenario.

However, signing an agreement stating “I’m a contractor, not an employee” does not necessarily make it so. A host of different legal tests may apply in determining whether a worker classified as a contractor is really an employee. How can you avoid misclassification and the significant penalties that can follow?

Kurt Barker and Jon Napier from Karnopp Petersen LLP and Evan Dickens from Jones & Roth, CPAs and Business Advisors, will address the following and more:

     • Why does independent contractor versus employee status matter?
     • What are the requirements/tests for independent contractor vs. employee?
     • What are the most common pitfalls to avoid, and some strategies for minimizing your risks?
     • What is the cost of getting it wrong — and what do you do then?

Cost to attend this event (including a buffet lunch) is only $25 for Chamber members and $45 for non-members. RSVPs are a must! Don’t miss out.

Most all of you know that having an effective, up-to-date employee handbook is key to minimizing the risk of employee claims. There is a lot more to writing an effective handbook than simply restating that employment is "at-will"-in fact, poorly-designed policies can sometimes create more trouble than having no policy at all! But with all the pressures on business these days, it can be hard to devote the time and attention to keeping your policies complete and in legal compliance. Dust off that handbook and join us on March 29th for an engaging look at what to consider, what to embrace, and what to all together avoid in your handbook. Don't let delays or inaction give you a real headache (or liability) down the road!
